The National Markets and Competition Commission (CNMC) has announced sanctions against Ibai Llanos, Jordi Wild and Nachter, three of the most prominent Spanish creators. It is due to failure to comply with its obligations regarding advertising and protection of minors, in accordance with the General Law of Audiovisual Communication in content disseminated on video platforms and social networks.
These are separate files that the Commission has released on the same day through a statement in which it announces sanctions to three influencers and content creators or EBUs (Users of Special Relevance, according to the name established by law) for content disseminated on YouTube, X, Instagram and Facebook.
Each creator has breached a different aspect of the regulations:
- Ibai Llanos is blamed for the lack of clear identification of commercial communications
- To Jordi Wild the absence of adequate measures for the protection of minors
- A Nachter the dissemination of advertising of medicines without respecting the specific applicable requirements
Ibai Llanos and the lack of identification
The sanction imposed on Ibai Llanos corresponds to part of the communication made to publicize details of “La Velada V”, that is, the edition corresponding to 2025, which took place on July 26 at the La Cartuja stadium, in Seville. According to the 25 pages of the file, Ibai Llanos presented the musical artists who would perform at the event using videos that showed personalized Coca-Cola cans with their corresponding names. None of the four publications made on X were clearly identified as advertising.
The CNMC considers that there was no clear signage that would allow commercial communication to be differentiated from editorial content; and remember that one of the basic obligations of users of special relevance is that the advertising can be clearly recognized by the viewer.
Specifically, the commission emphasizes that audiovisual commercial communications must be differentiated from editorial content through optical, acoustic or spatial mechanisms; and explains that said identification is especially important when the promotion of products or brands is integrated into the content itself, since the user must be able to know, in a simple way, when they are viewing a commercial communication.
For this reason, the Commission imposes a fine of 710 euros on Ibai Llanos, which, however, has been reduced to €568 for advance payment. According to the file, the calculation of the sanction has taken as a reference the income declared by the creator with respect to the previous year and has taken into account the limited impact on the audience, the cessation of the offending conduct prior to the processing of the sanctioning procedure, the immediate correction of the offending non-compliance and the degree of guilt.
Jordi Wild and the absence of measures for the protection of minors
For its part, the sanction imposed on Jordi Wild corresponds to the third edition of the “Dogfight Wild Tournament”, an event that took place on January 31, 2025 and was broadcast live on the YouTube channel @elrincondegiorgio. The content is still available on said channel and on @dwt_fighting, dedicated to the event.
“Dogfight Wild Tournament” consists of a mixed martial arts (or MMA) tournament in which combatants face each other in different disciplines and with different rules. The content lasts 3 hours and 57 minutes, which includes a total of 9 confrontations of different types. In addition, the Commission has also identified some videos of the event in the “Shorts” section of YouTube.
By considering them to be violent confrontations, the CNMC considers that Jordi Wild should have warned and informed sufficiently and unequivocally that the event could be detrimental to the physical, mental or moral development of minors and activated the mechanisms available on the platform to restrict access to minors since it involved extreme contact combat content.
Explain that the creator should have included the “+18” age rating. This has been included a posteriori.
The analysis of the content has taken place in accordance with a letter sent by the Audiovisual Council of Andalusia that conveyed a claim presented by the Andalusian Ombudsman. The file dedicated to Jordi Wild has 47 pages, and in them it reminds that particularly relevant users must unequivocally report content that may be harmful and use description systems, warnings, visual symbols or other appropriate technical means to do so.
The CNMC highlights that the lack of qualification can limit the effectiveness of parental control systems, since these tools depend on the content being correctly identified in order to function properly. Two fines have been imposed, one for each YouTube channel, which total €1,543.44. The amount has been reduced to €1,241.95 due to advance payment.
Nachter and drug advertising
For its part, the Nachter file is related to commercial communications about “anti-flu” drugs made on the creator’s channels on Facebook and Instagram, and which were available between January and March 2025. The Commission has determined that these publications did not comply with the requirements established for the advertising of drugs.
In this sense, remember that the advertising of medicines is subject to specific rules. It details that its advertising nature must be clear, the product must be identified when appropriate and include essential information for correct use, as well as warnings, including the invitation to read the leaflet or consult the pharmacist in case of doubt. This seeks to protect consumers and prevent drug advertising from misleading or encouraging inappropriate use of these products.
The CNMC has imposed two fines on the creator, one for each channel on which the communications were made, amounting to a total of 1,779.94 euros. The fine has been reduced to 1,067.96 euros after recognition of responsibility and advance payment.
CNMC reminders
The CNMC closes its statement saying that “The obligations do not depend solely on the platform on which the content is disseminated“and who are the users of special relevance (UER)”that sell or organize commercial communications, or that disseminate content potentially harmful to minorss” those who “They must act with the diligence typical of a professional activity and know the applicable regulations“.
He also emphasizes that the objective of the regulation is “protect consumers, especially minors, and ensure that audiences can clearly distinguish between editorial content, entertainment and advertising.”.
The announcement of the sanctions comes just a few weeks after the requirements directed at five content creators (Sofía Suescun, Tamara Gorro, Peldanyos, Samantha Vallejo-Nájera and Lola Lolita) for the incorrect identification of commercial communications on social networks. In all cases, as the Commission pointed out, the publications promoted products or services without incorporating within the video itself a sufficiently clear warning about its advertising nature.
The amount of sanctions imposed on Ibai Llanos, Jordi Wild and Nachter could be interpreted as low compared to the high income they presumably generate from their advertising actions. However, it could be understood that the CNMC resolution does not have a fundraising purpose, but rather a pedagogical and informative one. The Commission would seek to remember the regulation, the value of complying with it, and set precedents.
